General Terms and Conditions for Accommodation Contract

(Scope of application)
Article 1: The accommodation contract and related agreements entered into by the hotel with the guest shall be in accordance with the provisions of these general terms and conditions, and any matters not provided for in these general terms and conditions shall be in accordance with laws and regulations or generally established customs.
In the event that the hotel agrees to a special agreement to the extent that it does not contravene laws, regulations, and custom, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.
(Application for accommodation contract)
Article 2: A person who wishes to apply for an accommodation contract with the hotel shall provide the following information to the hotel.
(1) Name of the person staying
(2) Occupation
(3) Address
(4) Contact information (telephone and e-mail address)
(5) Accommodation schedule and estimated time of arrival and departure
(6) Room charge (in principle, based on the basic room charge specified in the attached rate schedule)
(7) Other items deemed necessary by the hotel
2. In the event that a guest requests to continue his/her stay beyond the date of stay stipulated in item 2 of the preceding paragraph during his/her stay, the hotel shall treat such request as a new application for a contract of accommodation at the time such request is made.
(Formation of Accommodation Contract, etc.)
Article 3: The accommodation contract shall be concluded when the hotel has accepted the application as described in the preceding article. However, this shall not apply when the hotel proves that it did not give its consent.
2. When the accommodation contract has been concluded pursuant to the preceding paragraph, an application fee determined by the hotel shall be paid by the date designated by the hotel, within the limit of the basic accommodation charge for the period of stay.
3. the deposit shall first be applied to the room charge ultimately payable by the guest, and if a situation arises where the provisions of Articles 6 and 15 apply, the deposit shall be applied in the order of penalty followed by compensation, and any remaining amount shall be returned at the time of payment of the charge pursuant to the provisions of Article 11.
4. In the event that the application fee stipulated in paragraph 2 is not paid by the date designated by the hotel in accordance with the same paragraph, the accommodation contract shall cease to be effective. However, this shall apply only in the event that this hotel has notified the guest to that effect when designating the date for payment of the application fee.
(Special clause that does not require the payment of an application fee)
Article 4: Notwithstanding the provisions of Paragraph 2 of the preceding article, the hotel may accept a special agreement that does not require payment of the application fee as specified in the same paragraph after the contract is concluded.
2. In the event that the hotel does not request payment of the application fee as stipulated in Paragraph 2 of the preceding article or does not specify the date for payment of said application fee upon accepting the application for an accommodation contract, the hotel shall be deemed to have accepted the special agreement stipulated in the preceding paragraph.
(Refusal to enter into an accommodation contract)
Article 5: The hotel may refuse to conclude a contract of accommodation in the following cases
(1) When the application for accommodation is not in accordance with these general terms and conditions.
(2) When there is no room available due to full occupancy.
(3) When it is recognized that the person seeking accommodation is likely to conduct himself/herself in a manner contrary to the provisions of the law, public order, or good morals in connection with the accommodation.
(4) When it is recognized that the person who intends to stay falls under any of the following (a) through (c).
(a) Boryokudan or Boryokudan-associated persons or other antisocial forces
(b) Boryokudan or Boryokudan-involved persons or other organizations that control the business activities of Boryokudan or Boryokudan-involved persons
(c) A juridical person that has an officer who falls under the category of Bouryokudan-in (organized crime group) member.
(5) When a person seeking accommodation has said or done something that causes significant inconvenience to other guests
(6) When the person seeking accommodation is clearly recognized as a person with a contagious disease.
(7) When a violent demand is made with regard to the accommodation, or when a burden exceeding a reasonable range is demanded.
(8) When services cannot be provided due to natural disasters, breakdown of facilities, or other unavoidable reasons.
(Guest's right to cancel the contract)
Article 6: The guest may cancel the accommodation contract by making a request to the hotel.
2. In the event that the accommodation contract is cancelled in whole or in part for reasons attributable to the guest (except in the event that the hotel has designated a date for payment of the application fee and requested payment thereof pursuant to Article 3, paragraph 2, and the guest has cancelled the accommodation contract prior to such payment), the hotel shall charge a penalty fee in accordance with the attached schedule of charges. ), the hotel will charge a penalty fee in accordance with the attached schedule of charges. However, in the event that this hotel has agreed to the special contract stipulated in Article 4, Paragraph 1, this will only be the case when this hotel has notified the guest of the obligation to pay the penalty when the guest cancels the accommodation contract in response to the special contract.
3. If the guest does not arrive at the hotel by 6:00 p.m. on the day of the stay (or 2 hours after the estimated time of arrival, if such time has been specified in advance), the hotel may deem that the accommodation contract has been cancelled by the guest and treat the situation as such.
(The hotel's right to terminate the contract)
Article 7: The hotel may cancel the accommodation contract in the following cases
(1) When it is recognized that the guest is likely to commit an act contrary to the provisions of law, public order, or good morals in connection with the accommodation, or when it is recognized that the guest has committed such an act.
(2) When it is recognized that the lodger falls under any of the following (a) through (c)
(a) Boryokudan (organized crime groups), Boryokudan members, quasi-organized crime groups, or persons related to organized crime groups, or other anti-social forces
(b) When the guest is a juridical person or other organization whose business activities are controlled by a crime syndicate or a member of a crime syndicate
(c) A juridical person, one of whose officers falls under the category of Bouryokudan-in (organized crime group) member.
(3) When a guest has said or done something that causes significant inconvenience to other guests
(4) When it is clearly recognized that the lodger is a person with a contagious disease.
(5) When a violent act of demand is committed in connection with the accommodation, or when a burden exceeding a reasonable range is demanded.
(6) When the hotel is unable to accommodate the guest due to a force majeure such as a natural disaster.
(7) When a guest does not comply with the prohibitions (limited to what is necessary for fire prevention) of the rules of use established by the hotel, such as smoking in the bedroom, tampering with firefighting equipment, etc.
When this hotel cancels the accommodation contract in accordance with the provisions of the preceding paragraph, the hotel will not charge the guest for accommodation services that have not yet been provided.
(Registration for lodging)
Article 8 Guests shall register the following items at the front desk of the hotel on the day of their stay.
(1) Guest's name, occupation, address and contact information (telephone number and e-mail address)
(2) In the case of a foreigner, nationality, passport number, place of entry and date of entry
(3) Date and estimated time of departure
(4) Other items deemed necessary by the hotel
2. If the guest intends to pay the charges in accordance with Article 11 by a method that can substitute for currency, such as electronic currency or credit card, the guest is required to present them at the time of registration in advance as described in the preceding paragraph.
(Room usage time)
Article 9: Guests may use the guest rooms of the hotel from 4:00 p.m. to 10:00 a.m. the following morning. However, in the case of a consecutive stay, the guest may use the room for the whole day except for the day of arrival and the day of departure.
(Compliance with usage rules)
Article 10: Guests shall abide by the rules of use established by the hotel and posted in the hotel.
(Payment of fees)
Article 11: The breakdown of accommodation charges, etc. payable by the lodger shall be as set forth in the attached schedule of charges.
2. The payment of accommodation charges, etc. set forth in the preceding paragraph shall, in principle, be made at the time the reservation is confirmed, in currency or by a method that can be substituted for currency such as electronic currency or credit card accepted by the hotel. However, in case of unavoidable circumstances, the payment may be made during the period of stay as long as this hotel allows.
3. Room charges shall apply even if a guest voluntarily does not stay at the hotel after the hotel has provided a room to the guest and made it available for use.
(Responsibility of the hotel)
Article 12: The hotel shall compensate for any damage caused to the guest in the performance of the accommodation contract and related agreements, or in the non-fulfillment of such agreements. However, this shall not apply when the damage is not caused by reasons attributable to the hotel.
(Handling of cases where the contracted room cannot be provided)
Article 12: If the hotel is unable to provide the guest with the contracted room, the hotel shall, with the consent of the guest, arrange for other accommodation under the same conditions as far as possible.
2. If, notwithstanding the provisions of the preceding paragraph, the hotel is unable to find other accommodation, the hotel shall pay the guest a compensation fee equivalent to the amount of the penalty, which shall be applied to the amount of compensation for damages. However, if there is no reason attributable to the hotel for not being able to provide the guest room, no compensation shall be paid.
(Storage of baggage or personal belongings of guests)
Article 13: When a guest's baggage arrives at the hotel prior to his/her stay, the hotel will allow the guest to keep the baggage in the hotel only if the hotel understands this prior to the arrival. However, the hotel shall not be responsible for the management of the baggage.
2. If a guest's baggage or personal belongings are left at the hotel after the guest has checked out, and the owner of the baggage or personal belongings is found, the hotel shall contact the owner and request instructions from him or her. However, if the hotel does not receive instructions from the owner, or if the owner cannot be identified, the hotel will keep the property for 7 days from the date of discovery, and then report the matter to the nearest police station.
3. The hotel shall not be responsible for the safekeeping of baggage or personal belongings.
(Responsibility for parking)
Article 14: When a guest uses the parking lot of the hotel, regardless of whether or not the guest has deposited the keys to the car, the hotel will lend the guest a parking space and will not be responsible for the management of the car. However, the hotel shall be liable to compensate for any damage caused by the intentional or negligent management of the parking lot.
(Guest responsibility)
Article 15: In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.
Cancellation Policy
In the event of cancellation of a reservation, the cancellation fee will be calculated and charged according to the number of days remaining from the scheduled stay to the date of cancellation, as follows
〜13 to 14 days prior to the scheduled stay: 0%.
13 to 8 days prior: 30%.
7 days to 2 days prior: 50%.
The day before: 80%.
On the day of the event: 100%.
